Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the MellowFit app and website (“MellowFit”, “we”). By creating an account, joining a challenge, or using any of our services, you accept these Terms. If you do not agree, please do not use the service.

MellowFit is operated by Antonio Gutiérrez Aguayo, a sole trader registered in Mexico, tax ID (RFC) GUAA9407267G2, with tax domicile in Zapopan, Jalisco, Mexico. The full address is available on request by writing to contacto@mellowfit.com.mx, which is also the contact for anything related to these Terms.

1. Who we are and what MellowFit is

MellowFit is a fitness community “with a cause”: you commit to moving, you upload daily evidence of your activity, and whatever is generated by the days you miss is donated to a cause chosen by the community. MellowFit stands on three pillars: exercise, community, and cause.

3. The membership

$99 MXN a month is your MellowFit membership. Every challenge is included — it is not paid for separately. The membership gives you access to the challenges (you can be in one at a time), to the community (feed, chat, teams, ranking), and to the app’s features. The membership does not switch off between one challenge and the next: it stays active, and with it you enter the following one when it opens.

How you are charged: there are two routes, and which one you used determines how a refund works.

Cancellation: you can cancel your membership whenever you want. If you subscribed through the App Store, cancel from Settings → your name → Subscriptions on your iPhone. If you paid by link, from “Manage my membership” in the app or by writing to us at contacto@mellowfit.com.mx.

In both cases, cancelling stops future charges and your membership stays valid until the end of the period you already paid for. There is no proration and no penalty for cancelling.

Refunds of the monthly fee:

Refunds of fines: once donated to the cause they cannot be refunded, because we no longer hold the money. But if a fine was generated by an error on our side, we fix it — write to us before the edition closes and we will cancel it, or return it if you had already paid. A wrong charge does not stop being wrong because a system calculated it on its own.

4. The fines

For each committed day you do not complete, a fine of $50 MXN is generated. The cut-off is every Sunday, at the close of the week.

Fines are charged outside the app, through the same means as the membership. You have a 7-day grace window to cover them; if they are not paid within that window, your ability to upload evidence may be temporarily suspended until you are up to date, or you may be removed from the challenge.

5. Where the money goes

This is the most important part, and we say it plainly: there are two separate pots.

MellowFit is operated by a sole trader, not a registered charity. This means we do not issue tax-deductible receipts for fines or for the membership. At the close of each edition we publish proof of where the donated money went. The receiving organisation for this edition is announced before the challenge starts, along with proof of where the money went at the close of the edition.

6. Leaving a challenge early

You can leave a challenge whenever you want, and doing so carries no additional cost. We do not charge a penalty for leaving.

The only thing settled when you leave is the fines from days already past that went uncompleted. That money is not a penalty for leaving: it is what had already been generated, and it is donated in full to the cause, like every daily fine.

Removal on these grounds does not entitle you to a refund and does not waive fines already generated.

9. Changes, governing law, and jurisdiction

We may update these Terms to reflect changes in the service or in the law; we will publish the version in force on this page with its date. Relevant changes will be communicated through the means available.

These Terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Zapopan, Jalisco, without prejudice to the rights that Mexico’s Federal Consumer Protection Law grants to consumers, including the option of turning to PROFECO.
